Luminary Blueprint is powered by Shopify, which enables us to provide the Services to you.

We are committed to protecting your personal information. This Privacy Policy (the “Policy”) describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services on our Site or otherwise when you communicate with us. 1. Scope of the Privacy Policy

This Policy outlines how your personal information (your “Visitor Information”) is collected, used, and shared in connection with your access to and/or visitation or use of the Site. When accessing and/or using the Site and our Services, you may be asked to provide clear and unequivocal affirmative consent to the collection, processing, and sharing of your Visitor Information via opt-in procedures. We also collect, process, and share your information in accordance with our legal bases for use of your data, which are more fully described in Section 3.

 

The Site is owned and operated by Luminary, and this Policy only applies to Visitor Information obtained by Luminary in connection with or related to your use of the Site and our Services. This Policy does not apply to information collected by us offline or through any other means, including on any other website operated by us or any third party, including through any third-party applications, websites, or content (including advertisements) that may link to or be accessible from, or on, our Site.

 

This Policy may change from time to time as further described in Section 7, and your continued use of the Site means that you are agreeing to be bound by the most recently updated version of this Policy.

2. Personal Information We Collect or Process

We collect Visitor Information when you use our Site. Sometimes you submit Visitor Information to us yourself, other times your Visitor Information is collected automatically. The type or category of Visitor Information collected various based on how it was gathered. Visitor Information we collect may include information by which you can be personally identified such as your name, email address, physical address, phone number and other information that you voluntarily submit (e.g., when you submit an order on the Site). This information is primarily needed to maintain the security and operation of our Site, and for our internal analytics and reporting purposes.

Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. Luminary does not collect or process any data through our Site regarding the following:

• Race or ethnic origin;
• Political opinions;
• Religious or philosophical beliefs;
• Trade union memberships;
• Genetic or biometric data;
• Health or morality;
• Sexual activity or orientation; or
• Criminal convictions or offenses.

We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Site and Services, where you live, and as permitted or required by applicable law:

● Contact details including your name, address, billing address, shipping address, phone number, and email address.
● Financial information including credit card, debit card, and financial account numbers, payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details.
● Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
● Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.

We may collect personal information from the following sources:

Voluntary Submission

Luminary collects Visitor Information that is voluntarily provided by you or with your permission. For example, we ask you for information, such as your name, address, and payment information when you submit an order on the Site. All information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such information. You always have the option not to provide the information we request. If you choose not to provide the information we request, you can still visit the Site, but you may be required to provide your information by other means if it is needed to provide our Services to you.

We may not accommodate a request to change your Visitor Information if we believe the change would violate any law or legal requirement or cause your Visitor Information to be incorrect. Our Third-Party Vendors

We do not collect, process or store payment data ourselves. If you submit an order through the Site, your credit card (or other payment information) is processed using our third-party vendors through their online payment programs, including Shopify, Inc. Google Maps is a Third-Party Vendor that is used within the Services. Your use of the Services is subject to your acceptance of the Google Maps and Earth Enterprise Universal Acceptable Use Policy, Google Maps and Google Earth Additional Terms of Service and Google Privacy Policy as it may be amended by Google from time to time.

 

Amazon Web Services is a Third-Party Vendor that is used within the Services. Your use of the Services is subject to your acceptance of the AWS Customer Agreement, AWS Service Terms, AWS Trademark Guidelines, AWS Site Terms, and AWS Privacy Notice as it may be amended by Amazon Web Services from time to time.

 

OpenAI is a Third-Party Vendor that is used within the Services. Your use of the Services is subject to your acceptance of the Terms of Service, Privacy Policy, Service Terms, Data Processing Addendum, OpenAI Services Agreement as it may be amended by OpenAI from time to time.

 

Lulu is a Third-Party Vendor that is used within the Services. Your use of the Services is subject to your acceptance of the Lulu Terms of Service and Privacy Policy as it may be amended by Lulu from time to time.

Payment Card Industry Data Security Standard (PCI-DSS)

Our third-party vendors follow the Payment Card Industry Data Security Standard (PCI-DSS) when handling credit card data. Orders can be placed on the Site using VISA, MasterCard, Discover, and American Express credit cards, and PayPal, Google Pay, and Venmo as authorized payment methods for product orders. All payment transactions are processed using our third-party payment processor, Shopify, through their online payment programs, in adherence to PCI-DSS and other applicable standards. Luminary, at its sole election, may discontinue support for any payment method or it may support additional payment methods. We will update this Policy in accordance with Section 7 if we change our accepted payment methods or how we handle credit card data.

Third-Party Websites

The Site may contain links to websites and applications not owned or controlled by Luminary (“Third-Party Websites”). If you choose to click on a link for a Third-Party Website, that Third-Party Website may collect your personal information and/or information about your online activities over time and across difference websites, apps, and other online services website. We do not: (1) have any control over Third-Party Websites; (2) process any Visitor Information submitted to Third-Party Websites; and (3) endorse Third-Party Websites. We encourage you to be aware of Third-Party Websites and their privacy policies, as we are not responsible for their privacy policies or processing activities and practices. Please review the privacy policy of each website you visit before you submit any personal information.

Web Beacons

The web pages on our Site may contain electronic images known as web beacons (invisible images often referred to as pixel tags or clear GIFs) that allow us to recognize users, assess traffic patterns, identify preferred content, and measure engagement with our Site. We may also include web beacons in our e-mail messages for purposes such as counting how many e-mail messages have been opened.

Web beacons may also be placed by third-party service providers to help determine the effectiveness of advertising campaigns. These web beacons may be used by third-party service providers to place a persistent cookie on your computer. This allows the service provider to recognize your computer each time you visit certain web pages and compiles anonymous information in relation to those page views. This anonymous information enables us and our third-party service providers to learn which advertisements bring you to our websites and how you use the Site.

Log Files

• analyzing trends, traffic, and user behavior; administering the Site;
• gathering demographic information about our user base as a whole;
• tracking web and advertising analytics throughout the Site;

• educating Luminary about how the Site can continue to be improved.

Cookies fall into the following subcategories:

• Essential Cookies. Certain cookies are used for specific purposes that are essential to your secure use and navigation of the Site. Without them, Luminary cannot provide core functions and features of our Site to you. These cookies collect and use information such as your server preferences, single-session data and corresponding identifier, web beacons and log files, and other credential-related information. Essential cookies also help inform Luminary whether you require, or have already been served, an affirmative consent request in connection with our data policies and this Privacy Policy. Essential cookies also include analytics cookies, which provide us data that allows Luminary to better understand its users and improve the Site based on what we have learned from that data.
• Preference Cookies. Other cookies are used to collect and process information about your preferences and similar choices in connection with the Site in order tooptimize your browsing experience. Preference cookies include social media cookies, which collect information about your social media usage and other data you provide in connection with such usage (if you access the Site through a social media website or mobile application, you may have social media cookies). If you wish to modify or change your social media cookies, please visit the appropriate social media website, and review the settings related to your applicable social media account(s).
• Advertising Cookies. Our third-party providers may use cookies in connection with the Site to personalize the content you are shown while accessing the Internet. Analytics

Services providing analytic tools (“Analytic Services”), such as Google Analytics®, are used with the Site and transmit website traffic data to servers located within the United States. Analytic Services do not collect PII, identify individual users, or associate your IP address with any other data. We do not share any PII with our Analytic Services in connection with their performing of any services on our Sites. We use reports provided by Analytic Services to help us understand website traffic and webpage usage.

We collect non-PII, such as IP addresses, operating systems, links clicked, pages visited, browser type, time zone setting, browser plug-in types, and referring websites of visitors to our Site. This information is collected for statistical analysis purposes such as:

• maintaining the security and operation of our Site;
• determining web-traffic trends; and

3. How We Use Your Personal Information

We collect, process, and disclose your Visitor Information only for specific and limited purposes. Our primary goal in collecting, using, and sharing Visitor Information is to provide you with our Services, enhance your experience on the Site, support the Site, and improve the Site features, performance, and other elements. More specifically, our handling of your Visitor Information is generally limited to order processing, shipping products, and responding to general inquiries. We will not use your Visitor Information without a valid legal basis to do so, and we will only process your Visitor Information in a way that is compatible with and relevant to the purpose for which it was collected and authorized. You are not required to Provide us the data we request, but if you choose not to do so, we may not be able to provide you with our Services or respond to any inquiries you have.

Legal Bases for Data Usage

In general, Luminary processes your Visitor Information in accordance with the following legal bases:

• Consent. Where you have given us consent to process your Visitor Information for one or more specific purposes.
• Legitimate Interests. Where processing your Visitor Information is reasonably necessary to achieve our legitimate business interests. For example, we may process your Visitor Information to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, or in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
• Performance of a Contract. Where we have entered into a contract with you, or you have requested that we take steps prior to entering into a contract, we process your Visitor Information to fulfill the terms of our contract.
• Legal Obligations. Where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process. For example, we may process your Visitor Information in response to a subpoena, or in response to public authorities as necessary to comply with national security or law enforcement requirements.

In accordance with the legal bases for processing your Visitor Information discussed above, Luminary collects, uses, shares, and/or processes your Visitor Information for the following purposes:

● Provide, Tailor, and Improve the Services. We use your Visitor Information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications, to process purchases, returns, exchanges or other transactions, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, to present the Site and its content to you, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.
● Site Operation. We use your Visitor Information to provide hosting and other web-based services for us and the Site, to help us understand website traffic and webpage usage through our Analytics Services described in Section 2, to facilitate logistics services to handle shipping of orders placed through the Site, and to facilitate any warranty and/or product support claims.  
● Marketing and Advertising. We may use your Visitor Information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on other websites, including based on items you previously have purchased or added to your cart and other activity on the Services. By providing your Visitor Information to us via the Site, you hereby give consent to Luminary and our duly appointed agents and service providers to process your Visitor Information as provided, for the purposes of direct marketing by means of electronic communication. You consent to receiving marketing communications from Luminary via email, text message, and phone regarding our products and services. You acknowledge and understand that message and data rates may apply, and your consent is not required to buy goods or services. You understand that you may withdraw your consent at any time by contacting us using the contact information in Section 8. Please note, unsubscribing from our marketing communications will not prevent you from receiving transactional messages relating to orders, warranties, support, or service requests.
● Security and Fraud Prevention. We use your Visitor Information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services.
● Communicating with You. We use your Visitor Information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you.Additionally, we may send you communications required by law or which are necessary to inform you about the changes to the services we provide to you.
● Legal Reasons. We use your Visitor Information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.
● In the Event of Change of Control. The ownership or control of Luminary may change at some point in the future. Should that occur, it is in our legitimate interest for our Site and Luminary to be able to maintain a relationship with you. In the event of a change in ownership, merger, bankruptcy, or change in control of Luminary, your Visitor Information may be shared with the person or business that owns or controls the Site. You will be notified as described in Section 7 of this Policy. Opting out of receiving information from third parties will not affect our right to transfer your Visitor Information to a new owner, but your choices will continue to be respected regarding the use of your Visitor Information.

How We Disclose Personal Information

In certain circumstances, we may disclose your Visitor Information to third parties, including our Third-Party Vendors,for legitimate purposes subject to this Policy. Such circumstances may include:

● With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).
● With business and marketing partners to provide marketing services and advertise to you. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites. You can exercise your rights to opt-out of those uses here .
● When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
● With our affiliates or otherwise within our corporate group.
● In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Relationship with Shopify

The Site and Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Site and Services in order to provide and improve the Site and Services for you. Information you submit to the Site will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Site and Services for you. 4. How We Protect Your Information

Luminary takes the security of your Visitor Information very seriously. We take every effort to protect your Visitor Information from misuse, interference, loss, unauthorized access, modification, or disclosure. Our measures include implementing appropriate access controls, investing in information security capabilities to protect the IT environmentswe leverage, and ensuring we encrypt and anonymize personal data wherever possible. Access to your Visitor Information is only permitted among our employees and agents on a need-to-know basis, and subject to strict contractual confidentiality obligations when processed by third parties.

 

Your Visitor Information may be stored on servers owned and operated by Luminary and our affiliates or Third-Party Vendors (including Shopify), by cloud/software service providers (“SaaS Services”) located in the United States. Our SaaS Services are committed to using industry-standard physical, electronic, and organizational safeguards to protect information against loss or theft as well as unauthorized access and/or disclosure. To prevent unauthorized access or disclosure, to maintain data accuracy, and to allow only the appropriate use of your Visitor Information, we utilize industry standard physical, technical, and administrative controls and procedures to safeguard the information we collect. To help ensure the integrity and privacy of the Visitor Information that you provide to us, we encrypt that information using secure socket layering (“SSL”).

 

We follow generally accepted industry standards to protect Visitor Information submitted to us, both during transmission of such information and during storage once we receive such information. When entering Visitor Information on the Site, look for the secure icon (typically an image of a lock) and ‘https’ designation in the address box of your browser window that indicates you are on a secure page. However, it must be noted that “perfect security” does not exist today. 5. How Long We Keep Your Visitor Information

We will only keep your Visitor Information for as long as it is necessary for the purposes set out in this Policy, unless a longer retention period is required or permitted by applicable law (such as tax, accounting, or other legal requirements). No purpose in this Policy will require us to keep your Visitor Information for longer than reasonably necessary.

 

When we have no ongoing legitimate business need to process your Visitor Information, we will either delete or anonymize such information, or, if this is not possible (for example, because your Visitor Information has been stored in backup archives), then we will securely store your Visitor Information and isolate it from any further processing until deletion is possible. We will actively review the Visitor Information we hold and delete it securely, or in some cases, anonymize it when there is no longer a legal, business, or consumer need for it to be retained.

• Request Luminary erase any personal data about you that we have collected, in specific circumstances, where we no longer have a legitimate overriding interest or the purpose for which we process your personal data has expired;
• Request Luminary restrict the processing of your personal data, under certain conditions, generally while we are deciding on an objection you have made;
• Request Luminary deliver the personal data it holds about you in a commonly used format and request that such data be transmitted to another controller;
• Request Luminary cease processing your personal data based on your objection to such processing for reasons related to your individual circumstances or where you have withdrawn consent; and

In some instances, Luminary requires explicit consent from you to process certain personal data. In any event, Luminarywill clearly explain what personal data is being collected and/or processed and how it will be used. Luminary only collects the minimum amount of personal data necessary to perform its services. Explicit consent may always be retracted at any time by a data subject covered under GDPR.

Luminary’s ability to fulfill a request to exercise your rights, as outlined above, is subject to certain restrictions and circumstances outlined in GDPR. Residents of California

Luminary does not sell any personal data it collects about you to third parties. Luminary shares data related to Log Files, Web Beacons, and Analytic Services with third parties in connection with maintaining and improving the Sites. If you are a resident of California, under the California Consumer Privacy Act (“CCPA”), you have the right to:

 

• Request Luminary disclose the categories and specific personal data that it has collected;
• Request Luminary provide you with a copy of your personal data that it has collected;
• Request Luminary delete any personal data about you that it has collected;
• Request Luminary not share your personal data at any time (the “right to opt-out”);
• Request Luminary correct any inaccurate personal data it maintains about you; and
• Request Luminary restrict its use and disclosure of your sensitive personal data.

Luminary will not discriminate against you if you exercise any of your rights under the CCPA. Please note that California law requires us to verify the requests we receive from you when you exercise certain rights listed above. We may ask you to provide additional information to us in order for us to verify the request.

 

California’s “Shine The Light” law (California Civil Code §1798.83), permits users of our Site who are California residents to request certain information regarding our disclosure of Visitor Information (if any) to third parties for direct marketing purposes. If you are a California resident and would like to make such a request, please submit your request in writing in accordance with Section 8 of this Policy.

Residents of Nevada

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Please note that we may transfer, store and process your Visitor Information outside the country you live in.
